12/23/2026, The Lindsay Clancy Trial - Investigation, Trial Strategy, Forensics & Ethics

*Please read below for information on how to get your Zoom link if you purchase a webinar.  You will NOT be emailed a link automatically.  You must fill out the very short Zoom form to get your link after purchasing any webinar from us. Freestone does not have the ability to link to Zoom automatically. Please note that the “success” page from Zoom doesn’t always display in Freestone correctly after you fill out the Zoom form and you will get some kind of “refused to connect” message. Please check your email to see if you got your link because 99% of the time, Zoom does capture the information, the success page just doesn’t populate right.

Course Description
The prosecution of Lindsay Clancy stands as one of the most legally, ethically, and psychologically intricate criminal matters in recent history. Arising from the January 2023 deaths of her three young children in Duxbury, Massachusetts, the case immediately drew national attention and sparked profound debate across the legal and medical communities. Central to the proceedings are complex intersections of severe postpartum mental illness—including postpartum depression and psychosis—the impact of extensive prescription psychiatric regimens, and the heightened threshold required to prove criminal responsibility and deliberate premeditation.

This continuing legal education program utilizes the Clancy case as an in-depth framework to examine the critical mechanics of case evaluation, charging decisions, and trial advocacy. Attendees will explore core prosecutorial ethics, focusing specifically on ABA Model Rule 3.8 and the ABA Criminal Justice Standards governing charging discretion. The session addresses the difficult ethical calculus required when evaluating whether to decline, defer, or pursue formal charges in high-stakes cases where statutory probable cause exists but justice, diminished capacity, or mental health mitigation argue against prosecution.

In addition, the course reviews successful litigation strategies employed by trial counsel in handling complex psychiatric defenses, evaluating conflicting expert testimony, selecting impartial juries under intense media saturation, and navigating the evidentiary limits of Rule 403. Whether practicing criminal defense, prosecution, or complex trial advocacy, practitioners will gain essential insights into balancing ethical obligations with courtroom strategy in high-profile, emotionally charged litigation.
